Gardeners Hammersmith Terms and Conditions
These Terms and Conditions set out the basis on which Gardeners Hammersmith provides gardening and related outdoor maintenance services to residential and commercial customers. By making a booking, accepting a quotation, or permitting work to begin, you agree to these terms. Please read them carefully before confirming any service.
These terms apply to gardening services provided within Hammersmith and the surrounding areas we agree to cover from time to time. Service availability may vary depending on location, access, weather, staffing, and the type of work required. We may refuse or postpone work where conditions are unsafe, unsuitable, or outside our normal service offering.
1. About Our Services
We provide gardening and outdoor maintenance services that may include lawn care, hedge trimming, pruning, planting, weeding, seasonal tidy-ups, garden clearance, and other agreed garden-related tasks. The exact scope of work for each booking will be confirmed in the quotation, booking confirmation, or written service summary we provide before the work begins.
Unless stated otherwise, any estimate or quotation is based on the information you provide to us and any inspection we carry out. If the actual condition of the site differs from the information supplied, or if additional work becomes necessary, we may revise the price, work schedule, or team allocation before continuing.
2. Booking Process
You may request a service by contacting us and providing details of the property, the work required, preferred dates, access arrangements, and any relevant instructions. Where necessary, we may ask for photographs, measurements, or a site visit to assess the work and prepare an accurate quotation.
A booking is only confirmed when we have accepted the job and provided confirmation of the agreed date, time window, and scope of work. Any quotation issued before confirmation remains subject to change if the information supplied is incomplete or materially inaccurate.
It is your responsibility to ensure that the property can be accessed safely and that any pets, valuables, fragile items, irrigation systems, decorative features, and obstructions are made known to us before the visit. If access is not available at the agreed time, or if the site is not ready for work, we may charge a call-out fee or rescheduling fee where reasonable.
We aim to attend at the agreed time, but arrival times may be affected by traffic, weather, equipment issues, or prior job overruns. Any times given are estimates unless expressly stated otherwise.
3. Pricing and Payments
Prices will usually be based on a fixed quotation, an hourly rate, or a combination of both, depending on the nature of the work. Unless otherwise stated, prices are quoted in pounds sterling and may include or exclude VAT as specified in the quotation. If VAT applies, it will be shown clearly where required.
Payment terms will be confirmed at the time of booking or in the quotation. For one-off jobs, payment may be required on completion of the work. For larger projects or repeat services, we may request a deposit, staged payments, or advance payment. Where a deposit is taken, it may be used to cover administrative costs, reserved labour, or materials ordered specifically for your job.
Invoices must be paid by the due date shown. If payment is not received on time, we may charge interest and recovery costs in accordance with the Late Payment of Commercial Debts legislation where applicable, or otherwise take reasonable steps to recover the outstanding amount. We reserve the right to suspend future services until all overdue amounts have been paid.
Any additional work requested by you during the visit, or any necessary extra work identified on site, will be chargeable unless we agree otherwise. We will normally seek approval before proceeding with material changes to the agreed scope or price.
4. Cancellations and Rescheduling
If you need to cancel or rearrange a booking, you should give us as much notice as possible. For one-off appointments, cancellations made with insufficient notice may be subject to a cancellation fee to cover allocated labour, travel, or preparation costs. The exact fee may depend on the timing of the cancellation and the resources already committed to the job.
If we need to cancel or reschedule due to weather, safety concerns, staff illness, equipment failure, or circumstances outside our reasonable control, we will contact you as soon as reasonably practicable to arrange an alternative date or time. We will not usually be liable for indirect losses caused by such postponements.
Where a booking is postponed because the site is unsuitable for work, access is prevented, or required permissions have not been obtained, we may charge for wasted attendance time or rescheduling.
5. Customer Responsibilities
You are responsible for telling us about any known hazards or special conditions at the property before work starts. This includes hidden cables, underground services, unstable surfaces, broken paving, pest issues, asbestos, aggressive animals, restricted access, or protected plants and features that should not be disturbed.
You must ensure that the property owner, landlord, managing agent, or any other relevant person has authorised the work if you are not the sole owner. By booking us, you confirm that you have the authority to allow the services requested.
You should remove or secure personal belongings, outdoor furniture, ornaments, tools, toys, and any other items that may be damaged or obstruct the work. We may move light items where necessary to complete the job, but we are not responsible for damage to items left in working areas unless caused by our negligence.
6. Materials, Plants, and Equipment
Where we supply plants, soil, mulch, compost, fertiliser, or other materials, we will use reasonable care in sourcing and handling them. Natural products may vary in appearance, size, colour, and seasonal condition. We cannot guarantee exact matching unless specifically agreed in writing.
Any plant care advice we provide is given in good faith based on the information available at the time. Plant health may be affected by weather, pests, disease, soil conditions, watering, or factors outside our control. Unless we have expressly agreed to maintain plants under a formal care plan, we do not guarantee survival or long-term performance of any plantings.
We supply and use our own tools and equipment unless agreed otherwise. If you request that we use your equipment, it must be safe, suitable, and in working order. We may refuse to use equipment that we believe to be unsafe or unsuitable.
7. Waste Removal and Regulations
Where waste is created as part of the service, we will manage it in a lawful and responsible manner. Green waste, clippings, cuttings, soil, and other garden debris may be removed from the site only if that is included in the service or separately agreed. If waste removal is included, charges may apply based on the amount, type, and disposal method required.
Waste generated from gardening work must be handled in accordance with applicable UK waste laws and local disposal requirements. This may include transferring waste only to authorised facilities or using licensed carriers where required. We do not promise that every material can be collected or removed if it is hazardous, contaminated, bulky, or otherwise subject to special disposal rules.
You must inform us in advance of any waste that may be classified as hazardous, restricted, or unusual, including chemicals, asbestos-containing materials, sharp metal, paint tins, oil containers, treated timber, or contaminated soil. We may refuse to handle such items or charge additional fees where lawful and appropriate.
Unless otherwise agreed, we are not responsible for removing non-garden household waste, builders’ waste, or items not directly generated by the gardening service.
8. Liability and Limitations
We will provide our services with reasonable care and skill. If we fail to do so, and this causes direct loss or damage, our liability will be limited to the amount paid or payable for the specific service in question, except where the law requires otherwise.
We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited under UK law.
We are not responsible for pre-existing damage, underlying defects, hidden conditions, poor soil structure, drainage problems, disease, pest infestations, or deterioration caused by weather, neglect, or factors beyond our control. We are also not liable for delays or failures caused by events outside our reasonable control, including severe weather, accidents, access issues, acts of third parties, or supply shortages.
Where there is a risk that work may affect delicate surfaces, aged structures, historic features, or nearby planting, you should tell us in advance. We may decline to carry out certain tasks if we believe there is a disproportionate risk of damage.
Any claim for damage or loss should be raised as soon as reasonably possible and, in any event, within a reasonable time after the service. You must allow us a fair opportunity to inspect the issue and, where appropriate, put matters right. We will not be responsible for losses that could reasonably have been avoided or reduced.
9. Complaints and Remedies
If you are unhappy with any part of our service, please raise the matter with us promptly so that we can investigate. We aim to resolve complaints fairly and quickly. Depending on the circumstances, our remedy may include correcting the work, returning to inspect the issue, offering a partial refund, or agreeing another reasonable solution.
Complaints will be considered in light of the agreed scope of work, the condition of the site, and any instructions or warnings provided before the service was carried out.
10. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, operating practices, or legal requirements. The version in force at the time of your booking will normally apply to that booking unless a change is required by law.
11. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms, the services we provide, or any related non-contractual matter will be subject to the exclusive jurisdiction of the courts of England and Wales.
12. General Provisions
If any part of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue in full force. A failure by us to enforce any part of these terms does not mean we waive our right to do so later.
These Terms and Conditions form the agreement between you and us regarding the services booked. Any variation must be agreed in writing or otherwise clearly confirmed by us before it takes effect.
